DIVORCE

Divorce requires legal determination of community property division, child custody/visitation, and support (spousal and child) either through negotiation, mediation , and/or trial. Brad Clark will represent you  aggressively, asserting your rights and securing your interests .

  • COMMUNITY PROPERTY- Simply stated Community Property is all property earned and/or acquired during the marriage including such assets as retirement plans, businesses, or any other form of personal or real property.  Gifts or inheritance may maintain separate property characterization. At dissolution of marriage, community property should be equally divided absent prior agreement between the parties. In some situations, agreeing on how community property is divided can be arduous.
  • CHILD CUSTODY- Generally a parenting plan is developed stressing what is in the best interest of the child which accommodates custody and visitation of the children by the divorced parents. Parenting plans can be difficult to negotiate often leading to demanding and emotionally draining trials.
  • SUPPORT- Child support is generally available to the custodial parent. Spousal support may be enforced so that each party can maintain the lifestyle assumed during marriage.  In most situations, spousal support is not intended to last a lifetime  

ALTERNATIVE DIVORCE PROCEEDINGS

In many divorces the parties remain friendly or at least civil.    Non-traditional divorce proceedings such as collaborative agreements or mediated settlements can reduce the emotional strain and cost of a divorce proceeding. Brad Clark offers these as alternatives to traditional divorce proceedings in such situations.

MARITAL AGREEMENTS

  • PRENUPS- Often the difficulties of a divorce can be anticipated and mitigated by use of what is commonly known as Pre-nuptial agreements.
  • POSTNUPTUAL AGREEMENTS-   Married couples often find themselves torn as to whether to continue a marriage or pursue divorce. Often, an agreement between married parties can be drawn that enables the marriage to continue by establishing conditions for continuance and agreements should the marriage fail.
